
TERMS OF SERVICE
These terms and conditions apply to the services provided by Chelsea Domenica, both as an artist under the name Chelsea and as an agency operating under the trade name Chelsea Music. These services include performances, the provision of technical equipment, and the booking of live artists, acts, and entertainment.
Agreement
By entering into a contract, the following is agreed upon between the parties:

Eindhoven, NetherlandsClient Represented by the person making the booking. The person representing the Client confirms that they have the necessary authority to place and sign the booking.
Considerations
The Client wishes to engage the Contractor, Chelsea Domenica, for a performance, including any additional services such as providing live musicians (e.g., saxophonist, percussionist, trumpeter, violinist, and/or singer/MC).
The Client assigns the Contractor to perform a show and any additional agreed-upon services.
The Contractor accepts the assignment under the following terms and conditions.
Performance Agreement
The Client commissions the Contractor to provide the following services, which the Contractor accepts:
Supplying artists, technical equipment, and/or performing as a DJ and/or vocalist.
Fees and Payments
The Client must ensure full payment within 7 days prior to the event date stated on the invoice.
The fee is exclusive of VAT (9% for performances and entertainment, 21% for technical equipment rental and other services).
Additional costs such as travel time, parking, and mileage (€0.23/km) will be charged unless agreed otherwise.
If the Client fails to meet payment obligations, they will be in default without further notice. Collection costs will be at the Client’s expense, and statutory interest will be applied.
Sound and Equipment
If required sound and visual equipment (DJ set and accessories) is not provided by the Contractor, it is the Client’s responsibility to arrange and cover associated costs.
No Resale or Transfer
The Client is not permitted to resell or transfer the services booked through the Contractor without prior consent.
Cancellation Policy
If the Client cancels the booking:
30 days before the booking: 25% of the agreed fee is payable.
15 days before the booking: 50% of the agreed fee is payable.
7 days before the booking: 100% of the agreed fee is payable.
Force Majeure
If the performance cannot proceed due to force majeure, the Contractor is not liable for any damages suffered by the Client or third parties.
Force majeure includes, but is not limited to, fire, equipment damage, illness, extreme weather, government regulations, curfews, political disturbances, and transportation issues.
In such cases, the Contractor will notify the Client as soon as possible.
Government Regulations
If an event is canceled due to government restrictions, a 25% cancellation fee will be invoiced.
Liability
The Client acknowledges and agrees that the Contractor and/or provided services cannot be held liable for damages or costs arising from the agreement.
Confidentiality and Reputation
Both parties agree not to make any negative statements about each other that may harm their reputations.
The contents of the agreement are confidential.
Any amendments or additions must be agreed upon in writing.
This agreement is governed by Dutch law. Any disputes will be settled by the competent court in Amsterdam.
International Bookings
For performances abroad, the Client must provide for the Contractor and any applicable personnel:
Round-trip flights to the nearest airport.
A double room in a 4-star or 5-star hotel.
Transport between the airport, hotel, and venue.
Meals and drinks during and after the event for the entire stay.
A private dressing room.
Security if required.
Necessary visas and work permits.
All these costs are the responsibility of the Client.
If the Client fails to fulfill these obligations, they are in default without further notice, and all associated legal and collection costs will be their responsibility. Statutory interest will apply from the date of default.
Additional Services – Sound and Visual Equipment
If applicable, the Client commissions a third-party supplier to provide sound and visual equipment (DJ set and accessories). The same terms regarding fees, cancellations, liability, and force majeure apply, except for the payment conditions, which may have separate arrangements.
Additional Services – Artists and Acts
If applicable, the Client commissions musicians (e.g., saxophonist, percussionist, trumpeter, violinist, and/or singer/MC) to perform. The same terms regarding fees, cancellations, liability, and force majeure apply.
Confidentiality of Fees
Discussing fees with other involved parties is strictly prohibited.
